Permission is granted to temporarily download one copy of the materials (information or software) on Tekview’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • attempt to decompile or reverse engineer any software contained on Tekview’s web site;

In no event shall Tekview or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Tekview’s Internet site, even if Tekview or a Tekview authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on Tekview’s web site could include technical, typographical, or photographic errors. Tekview does not warrant that any of the materials on its web site are accurate, complete, or current. Tekview may make changes to the materials contained on its web site at any time without notice. Any claim relating to Tekview’s web site shall be governed by the laws of the State of Stafford without regard to its conflict of law provisions.

Introduction

Tekview Limited’s Business Registered Number is 7543849 registered at 104/106 Market Street, Ashby De La Zouch, Leicestershire, LE65 1AP, United Kingdom with offices at Unit 8 George Holmes Business Park, George Holmes Way, Swadlincote, Derbyshire, DE11 9DF, United Kingdom. The terms and conditions set out below are designed to clearly define Tekview’s obligation to you. Upon purchase you also agree to abide by the terms and conditions set out below.

Payment Methods

Payment for purchase of any goods and/or services should be made by electronic bank transfer, cheque will also be accepted but funds will need to clear before we ship any goods/services.

Credit Accounts

It is our policy to send a proforma invoice for payment of any goods/services before supply unless credit terms have been agreed. To apply for a credit account please fill in and sign the Tekview Credit Application Form and return this to us. If you have a credit account with Tekview Limited payment is due 30 days after the date of our invoice unless agreed in writing prior to receiving and supplying your order. If these terms are not met, we reserve the right to charge statutory interest on the amount outstanding, this is 8% plus the Bank of England base rate. The current Bank of England base rate is 5.25%, so statutory interest for a recent debt would be 13.25% (correct as of August 2023).

Go Cardless Direct Debit

GoCardless (company registration number 07495895) is authorised by the Financial Conduct Authority under the Payment Services Regulations 2017, registration number 597190, for the provision of payment services.

EstateView Service

EstateView has a minimum 12-month contract, after the initial 12 months contract a rolling 12- month contract will continue (if you already have a test account then the official start date will be specified by email upon receipt of your order or on your invoice). We require 30 days’ notice of cancellation in writing. Payment for EstateView can be either monthly or annually, payment for this service is required via direct debit through our payment provider Go Cardless, unless agreed otherwise. By placing an order for EstateView you agree to these terms and conditions. The included SMS’s per month are outbound from EstateView.

It is your responsibility to test the EstateView service and ensure it is working with your SIMs/Tekview devices before committing to and paying for the EstateView service.

Any additional SMSs above the monthly inclusive amount are charged in line with the current price list per SMS excluding UK VAT unless specified otherwise in writing. Any additional SMSs over and above your monthly allocation will be taken by direct debit or invoiced. All SMS’s per month included are aggregated across your EstateView account of devices however any unused SMS’s are not carried over to the next month. The monthly/yearly price will increase pro-rata in line with the EstateView pricelist if the number of the devices within your EstateView account increases. Each EstateView account is assigned one SMS gateway number, this SMS gateway number is the mobile/cell number which all of your EstateView account communication is communicated through. EstateView needs extremely specific rules and factors to operate as intended, there are many factors that can stop communication between EstateView and your SIMs/Tekview devices. Your SMS gateway number could be any UK or international mobile/cell number, this will be determined by where you will be using your Powertxt® devices, and usually through an initial test account to ensure the service can communicate. There are several countries we cannot provide EstateView communication for due to our third-party supplier restrictions.

If any part of the communication chain changes (e.g. you change SIM supplier) this can disrupt your EstateView service as there are many factors that can stop communication between EstateView and your SIMs/Powertxt® devices. Our standard EstateView pricelist is for UK customers only, any international customers will require a specific quotation based on location and requirements. We operate a policy of continuous development and therefore we reserve the right to make changes and improvements to the design, functionality or any part of this service without prior notice. We cannot be held responsible in any way should this service be used other than for its intended purpose. EstateView online management portal has been created for Tekview Limited and is wholly owned by Tekview Limited. EstateView is run using third party company’s API’s and services, as such we, Tekview Limited, are not responsible or liable for any non-delivery of SMS’s or any other issues outside of our control (e.g. cloud servers going offline or an interruption of service). EstateView uses the service of the mobile networks and we have no control over these operators, we accept no responsibility for any loss (of any type) or financial penalties resulting from the EstateView online management service being unavailable or not working whether directly or indirectly.

We reserve the right to terminate your EstateView service at our discretion (e.g. if a Tekview supplier changes their service), we also reserve the right to restrict access to your EstateView account if your account is not paid up to date in line with our payment terms. We also reserve the right to increase prices in line with any third-party price increases we, Tekview Limited, may receive as these will be outside of our control.

SIM Contract Service

Any SIM card contract offered by Tekview Limited is provided by a third-party SIM provider. Any SIMs have a minimum 24-month contract, after the initial 24-month contract a rolling 12 month contract will continue. We require 30 days’ notice of cancellation in writing. All SIMs contracts have a SIM cancellation admin fee upon termination. Payment for each SIM contract can be either monthly or annually (this will be confirmed by Tekview Ltd), payment for this service is required via direct debit through our payment provider Go Cardless unless agreed otherwise. Each SIM card account is inclusive of an amount of SMS per month, this is currently 10 SMS per device per month unless specified in writing otherwise.

The included SMS’s per month are outbound from the SIM. If the price has been discounted from the standard UK Tekview pricelist the included number of SMSs is likely to be reduced, this will be detailed in writing. Any additional SMSs above the monthly inclusive amount are charged in line with the current price list per SMS excluding UK VAT unless specified otherwise in writing. Any additional SMSs over and above your monthly allocation will be taken by direct debit. The SMS’s per device included are not aggregated across your SIM contract account (unless agreed otherwise) and any unused SMS’s are not carried over to the next month. Any SIM contracts may be subject to a SIM contract cancellation fee issued by the network of which we have no control over, this will be passed on to you, the customer, with no uplift.

All SIM cards/contracts are provided by a third party and use the UK’s or international mobile networks, Tekview Limited, are not a mobile network operator and as such we, Tekview Ltd, have no control over any mobile network’s service or SMS delivery. We operate a policy of continuous development and therefore we reserve the right to make changes to part of this service without prior notice. We cannot be held responsible in any way should this service be used other than for its intended purpose. Any SIM contracts are operated using third party company’s API’s and network services, as such we, Tekview Limited, are not responsible or liable for any delay or non-delivery of SMS’s or any other issues outside of our control (e.g. cloud servers going offline or an interruption of service). We, Tekview Limited, accept no responsibility for any loss (of any type) or financial penalties resulting from your SIM contract service being unavailable or not working whether directly or indirectly. We reserve the right to terminate your SIM contract at our discretion (e.g. if a supplier changes their service), we, Tekview Limited, also reserve the right to restrict access to your SIM contract if your account is not paid up to date in line with our payment terms. We also reserve the right to increase any prices in line with any third-party price increases we, Tekview Limited, may receive as this will be outside of our control. The SIM pricelist and all SIMs offered are for UK customers ONLY with all SMS communication within the UK only, unless specified in writing. Any customers outside of the UK or SIMs requiring communication outside of the UK must obtain a written quotation detailing inclusions and pricing.

Delivery

You will be advised at the time of order if any goods are out of stock or if the goods are required to be specifically ordered for your order. We aim to despatch all orders the same day the order is received (if received before 12 noon GMT) and your credit account is up to date or you have paid for your goods in advance, this will be advised at the time of receipt of order. If your order is received after 12 noon it will be shipped the next working day. If the order cannot be shipped within these timescales for any reason we will advise as soon as possible when the goods are due to be shipped. We use DPD for most United Kingdom B2B deliveries, goods shipped by DPD will be shipped Next Day (within the UK) however smaller parcels maybe shipped by Royal Mail and as such may take 2-5 working days to arrive (within the UK). B2B International shipments are usually shipped by DHL, delivery time scales vary country to country so these will be advised at the time of order (smaller international parcels maybe shipped by Royal Mail and delivery times will be advised at the time of order or you can view the estimated shipment timeframes on Royal Mail’s website). Larger orders will be shipped using either DHL or a freight forwarder.

Shipping Prices: Shipping prices quoted are valid at the time of writing only and could be subject to change, any shipping price increases are outside of our control and all goods prices are exclusive of delivery.

Returns

We cannot accept any returns for any non-stock items (or if your order is for a larger quantity of stock items that would typically not be held in stock) as these will be ordered specifically for your order requirements. You will be advised at the time if your order consists of non-stock items or if your order is for a quantity of goods larger than would normally be held in stock (e.g. 50+ EU Powertxt®) and therefore specific to your requirement.

Stock goods may only be returned for credit if agreed in writing prior to the order being received by Tekview Limited. If goods are returned all goods must be received in their original supplied condition and packaging and returned to Tekview Limited within 30 days of the original invoice date. Goods cannot have been used, if the goods have been used they cannot be returned. For any agreed returned goods; if the goods are not returned in a saleable condition with all packaging still in-tact we reserve the right to charge a restocking fee. The customer/purchaser will bear all costs of return. Tekview Limited reserve the right to refuse full or part refund if we deem that the goods have been used or damaged in some way. If any shipment/order has been damaged by the carrier please contact us immediately in writing with evidence as soon as the package arrives so we can contact our carrier.

Warranty/Guarantee

All products supplied by Tekview Limited are guaranteed for 12 months against faults due to materials, workmanship or design. Warranty/guarantee periods can be extended if agreed with Tekview prior to the order being received (an additional fee will likely apply). Tekview Limited will refund or replace any product found to be defective within the warrantee period. This is a return to base warranty/guarantee so any faulty goods must be returned to Tekview Limited’s offices at your cost unless agreed otherwise. Please contact us prior to returning any faulty unit as technical assistance may resolve the issue. Please contact us for any faulty goods before returning so we can record the details of the fault and advise if we can offer a replacement. In the event of the product no longer being available Tekview Limited will offer a product of similar value and function where available, this will be advised at the time of order.

The seller undertakes to replace or repair, at its option, any goods supplied by the seller if a defect in material or workmanship arises under conditions of normal and proper use and maintenance (fair wear and tear accepted), provided that all of the following are true;

  • The goods were operated and maintained in accordance with the sellers operating instructions

  • The claim is first notified promptly in writing to the seller

  • The defect occurs within 12 months from the date of purchase of the goods by the buyer from the seller or reseller/distributor (proof of purchase date is required)

  • The goods have not been repaired or modified by anyone other than the seller or at the sellers direction

  • The device has not been tampered with in any way

A replacement physical good or part assumes the remaining warranty of the original physical good or 180 days from the date of the replacement of the repair, whichever is longer. If you believe your unit is faulty or not functioning as intended please contact us with the following information;

Product description, fault description, serial number and date of purchase (and any applicable order/reference numbers).

As some of our products are not manufactured by us (Tekview Limited) directly we keep copies of the required safety and product requirements as these tests have been done directly by the manufacturer.

VAT and Import Duty

Tekview Limited are a UK company and charge VAT on all goods and services at the standard UK rate of 20.0%. For all countries outside of the UK no VAT is charged.

All prices quoted exclude VAT unless stated otherwise.

Under UK VAT rules, VAT is applied to the charges of all couriers.

Our VAT registration number is GB 110101607. Our EORI Number is GB110101607000

Please be aware that your country may require payment of an import duty upon delivery. This is normally collected by the courier and is not connected to nor profited by Tekview Limited.

All prices quoted for customers outside of the UK are ex works and do not include any duties or taxes.

Privacy

Phone/Email Purchase

All phone / email purchases not on account are required to be paid in advance of shipping, this is by bank transfer only. For all SIM or EstateView contracts we require a direct debit facility to be set up in advance of shipping any goods or starting any services. For all direct debit payments collected we use the direct debit provider, GoCardless.

Other Customer Information

Customer information such as purchase made, invoice and delivery addresses and personal details such as name and job title are collected by Tekview Limited. We do not disclose, sell or otherwise distribute this information to third parties.

From time to time, Tekview Limited may email you details of offers, new products or news we think may interest you. If at any time you wish to opt out of any such communications by using the unsubscribe link on the relevant email or by contacting us by phone, email or letter.

All information is collected lawfully and we comply with the requirements of the Data Protection Act 1998 and subsequent GDPR legislation. Please refer to our privacy policy in full for more details.

Liability

Except as otherwise provided in these terms, and except where the goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law. Our liability (if any) under these terms in respect of any defect in the goods or of any duty owed to you under the terms shall be limited to the sale price of the goods. Where you are dealing as a consumer, none of the above policies shall affect your statutory rights.

All goods are supplied in good faith and the purchaser shall be responsible for ensuring the fitness of purpose for the purchaser’s applications. Tekview Limited cannot be held liable for error or loss during delivery by the courier, however, we will endeavour to resolve any issues on your behalf.

Any products sold by Tekview to any customer; our products are designed and intended for business use/applications only and to be installed and used by qualified IT professionals. All disclaimers, safety recommendations and important information as written in the user guide for each product should be adhered to. Tekview accepts no responsibility or liability for any damage, injury, loss or expense resulting from the use of our products whether directly or indirectly.

Force Majeure

Tekview Limited shall not be liable for any failure, delay or omission on its part arising from any cause beyond Tekview Limited’s reasonable control including (but not limited to) acts of God, war, fire, strikes or any other industrial disputes, power failure, failure of telecommunication connections or equipment or failure or defects in any hardware or software owned or supplied by third parties.

General

Tekview Limited reserve the right to decline any order for any reason.

These terms are governed by the laws of England and Wales and any disputes will be decided only by the courts of England and Wales.
